IN 14 STATES: Consumers can cash out merchant gift cards when balances fall below state-mandated thresholds ranging from $1 in Rhode Island to $10 in California. In Massachusetts, consumers can cash out gift cards when 10% (or less) of the original value remains. The limit in Connecticut is $3, but consumers must provide a purchase receipt. In Maine, consumers can only request a cash out in person. There are no "cash out" laws in 36 states; thus, stores in those areas can decide whether or not to give consumers the option. (Most don't.)

Beyond various "cash out" conditions, federal and state gift card laws are just as inconsistent regarding expiration dates, non-use fees, signage, and escheatment. Plus, there are more rules based on gift card type. For example, a promotional gift card may expire within a few months, but a retailer or bank-issued gift card may not.

The lack of clear and consistent gift card rules leads to consumer confusion and wasted gift cards.
